[1.1] You agree to use all HerefordHosting’s services and at your own risk. In no event will HerefordHosting be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages.
[1.2] The Customer agrees that it shall defend, indemnify, save and hold HerefordHosting harmless from any demands, liabilities, losses, costs and claims, including reasonable solicitor fees asserted against HerefordHosting, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, employees or assigns. Customer agrees to defend, indemnify and hold harmless HerefordHosting against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with HerefordHosting's server/services.
[1.3] HerefordHosting reserves the right to intervene with any of the sites hosted on its servers/services in the interest of its customers. Any material supplied by a customer infringing or allegedly infringing on the proprietary rights of a third party, copyright infringement, any defective products sold to customer from HerefordHosting's server/services. HerefordHosting shall be the sole judge of what violates this Policy.
[2.1] We bill monthly, quarterly, semi-annually, annually and one-time, depending on the plan/service. If you are not satisfied within your first 14 days we are happy to provide you with a full refund (advanced SSL certificates and Domain Name registration (URL) fee is non refundable). For Custom Setups/Custom work, a fee of £20/hr will be deducted from the refund; we will not charge you if this exceeds the amount of the refund.
[2.2] Free domain registration requires quarterly or longer payment plans (depending on the offer at the time) and renews at the normal domain registration rate after a year.
[2.3] If a chargeback is done on a payment made to HerefordHosting, you will get a request to reverse the chargeback. If the chargeback is not reversed within a reasonable amount of time. We will stop the account’s services until the chargeback is reversed or indefinitely.

We accept Visa, Master Card, American Express, and PayPal. We do not setup any hosting/services without full payment first, unless discussed beforehand. We do not offer any trials of any kind. Clients are encouraged to pay by PayPal as it is the easiest way to handle payments for both parties.
Our Web Hosting plans are not contractual based, however, they run on a rolling-basis. We will continue to charge you until you notify us to cancel. If payment stops, we will give you a grace period, afterwards we will cancel your services.

Our Web Hosting plans include a full no questions asked 14-day money back guarantee. If you are not satisfied with your service for any reason and cancel your account within 14 days of the activation, you will receive a full refund minus any additional / custom work, services, or custom set-up fees normally billed at £20 an hour. If our costs are more than the refund amount, no excess cost will be added to the client. We do not offer refunds for the following; Domain registration, SSL Certificates, and Site Builder. We do not offer refunds after 14 days, unless otherwise agreed. All requests for cancellation/refund must be received via a support ticket and must include owner verification via one of the following methods; ID, bill, transaction ID or another document with full name. You will receive a confirmation email upon the cancellation of your account.
We reserve the right to cancel your refund request if you do not prove ownership of the services requested for refund. We reverse the right to give you a refund if your account violates our Acceptable Use Policy.
[2.6] SPAM free servers. We do not allow any mass mailing to unsolicited email recipients and will stop any service in the case your account is proven to be using SPAM. We will also stop new signs once SPAM from a service has been confirmed. We do not allow what's called a "drop page" where SPAM e-mails direct their links to a web page on any service. Sometimes accounts can be labelled as SPAM accidentally, and we will take this into consideration depending on circumstances.
[3.1] All Web hosting services are billed on the date of activation. You have 7 days from the due date to pay for your services. After that, we reserve the right to cancel your services. If you need any extension to the 7 days, please contact us via Support Ticket.
[3.2] If you do not pay for your service to renew within 20 days after deactivation, your account will be terminated. You will receive an email reminder every 5 days till deactivation.
[3.3] The client is responsible for keeping backups of their service incase it gets terminated from late/missed payment.
[4.1] HerefordHosting shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from our servers going off-line or being unavailable for any reason whatsoever.
[4.2] Furthermore, HerefordHosting shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from any of our servers. All damages shall be limited to the immediate termination of service.
[5.1] HerefordHosting cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning.
[5.2] Certain services provided by HerefordHosting are resold. Thus, certain equipment, routing, software, and programming used by HerefordHosting are not directly owned or created by us.
[5.3] If any terms or conditions are failed to be followed, the account in question will be automatically deactivated.
[5.4] We reserve the right to remove any account without advanced notice for any reason without restitution as HerefordHosting sees fit.
[5.5] HerefordHosting retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification. It is the user's responsibility to check upon this page.
[5.6] HerefordHosting holds no responsibility for the use of our clients accounts; however, once made aware, we will internally investigate the client and their service.
[1.1] All services provided by HerefordHosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United Kingdom, United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or constitute violence, or material protected by trade secret and other statute/act.
[1.2] The client agrees to indemnify and hold harmless HerefordHosting and its employees from any claims resulting from the use of the service which damages the client or any other party.
[1.3] Our acceptable use policy is actively and strictly enforced. Illegal content or users are suspended from our network, usually within 48 hours after they are discovered, we will always inform you when and why any action has been taken to fix the issue. In some extreme cases, we will have to suspend the service right away.
[1.4] Adult content and pornography is allowed. This includes sexually explicit or hardcore content and/or advertising as long as any acts performed are legal. We do have strict rules against any content that can be interpreted or seen as under legal age (18) adult content. If believe your content does not fit unto our AUP, please use another host.
[1.5] The Client acknowledges and understands that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, the client agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.
[1.6] The Client further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
[1.7] Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, or trafficking, is not permitted on our network. HerefordHosting will help any LEA with investigations involving our clients partaking in illegal activities hosted on our services. We are very strict when it comes to this matter.
[1.8] Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.
[1.9] Websites hosted on our services must be of good performance standards. This is to ensure your users and our other clients services are not directly affected by you. We'll contact you if there is a load issue, it's very rare and easy to fix. In sever cases, we may need to directly remove your website from our services - it is important to keep backups of your websites in another location. WordPress websites overloading may require us to login and optimize it with security and optimizing plugins. We have a 8 maximum WordPress install limit per cPanel account. You'll need to purchase additional hosting if you require more. This is because WordPress can overload web hosting services very easily.
If a client is found doing something we deem against this Acceptable Use Policy, we will contact the owner. If this fails, we reserve the right to immediately cancel the service.
This AUP may be updated at any time. We reserve the right to act upon a client if found doing something we do not think is right, even if it isn't listed in this AUP.
[a] While acting as an Affiliate, you have to talk about HerefordHosting in well intentioned manner.
[b] You are responsible for providing up-to date information to your referral - We may provide a document outlining our services.
[a] You have to follow all points outlined in your personalised agreement with us.
[b] We may withdraw/edit our sponsorship at any time dependant on your performance or attitude towards HerefordHosting.
